Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and AI Beauty Bot, Inc., a Delaware C-Corporation ("Company", "we", "us", or "our").

By accessing or using the AI Beauty Bot service ("Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

AI Beauty Bot provides an AI-powered receptionist for beauty salons that automates client communication via messaging platforms, including automated appointment booking through integration with Altegio. The Service includes:

• Automated processing of incoming client messages via WhatsApp, Telegram, and Instagram.
• Appointment booking with real-time synchronization to the Altegio CRM system.
• Answering client questions about pricing, services, availability, and other salon-related inquiries.
• Sending appointment reminders to clients.
• A dashboard with analytics and configuration settings.

3. Account Terms

By using the Service, you represent and warrant that:

• You are a legal representative of a business entity or a sole proprietor operating in the beauty and wellness industry.
• You have read and agree to these Terms and our Privacy Policy.
• You have a lawful basis for processing the personal data of your clients and have informed them accordingly.
• You are at least 18 years of age and have the legal capacity to enter into this agreement.

4. User Obligations

You agree to:

• Provide accurate and up-to-date information about your salon's services, pricing, and schedule.
• Keep your Altegio data current to ensure the AI receptionist functions correctly.
• Not use the Service for spam, misleading communications, or any unlawful purpose.
• Obtain appropriate consent from your clients for the processing of their personal data in compliance with applicable laws.
• Pay all fees associated with your selected plan in a timely manner.

5. Our Obligations

We commit to:

• Maintaining Service uptime of at least 99.5% per month, excluding scheduled maintenance.
• Providing at least 24 hours' notice before any scheduled maintenance.
• Protecting personal data in accordance with our Privacy Policy and applicable data protection laws.
• Providing technical support for Service-related issues.

6. Payment Terms

• Pricing is determined by the current plans published at ai-beauty.bot/pricing. All prices are in US Dollars (USD).
• We offer a free trial period of 3 (three) calendar days.
• Subscription fees are billed monthly in advance for the upcoming billing period.
• We reserve the right to change pricing with at least 14 days' prior notice.
• If payment is not received within 5 days of the start of a billing period, we may suspend access to the Service.

7. Cancellation

• You may cancel your subscription at any time via the dashboard or by emailing us at hello@ai-beauty.bot.
• We may terminate your access if you violate these Terms, with 7 days' prior written notice.
• Upon cancellation, your data will be retained for 30 days and then permanently deleted. Earlier deletion is available upon request.

8. Intellectual Property

All rights to the Service, including but not limited to software, algorithms, design, trademarks, and other intellectual property, are owned by AI Beauty Bot, Inc. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with your selected plan. You may not copy, modify, distribute, or reverse engineer any part of the Service.

9. Limitation of Liability

• The Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted or error-free.
• We are not liable for any losses arising from inaccurate data in Altegio (incorrect prices, schedules, or services) provided by you.
• Our total aggregate liability shall not exceed the amount paid by you for the last month of Service usage.
• We are not responsible for outages or disruptions of third-party services, including messaging platforms and Altegio.
• In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms shall first be resolved through good-faith negotiation. If the parties cannot reach a resolution within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. The current version is always available at ai-beauty.bot/terms. Continued use of the Service after any changes constitutes acceptance of the revised Terms.
