1.General Provisions
1.1. This user agreement (hereinafter referred to as the Agreement) governs the interactions between the AI Beauty Bot service and users of the AI Beauty Bot (Mikhail Avdeev PR Beograd) service.
1.2. The current version of the Agreement shall be posted on the Internet on the Service website.
1.3. The Agreement shall enter into force from the moment the User expresses consent to its terms in the manner prescribed by Section 10 of the Agreement.
1.4. By starting to use the Service and/or the Site or their individual functions, the User is considered to have accepted the terms of the Agreement in full, without any reservations or exceptions.
1.5. If the User disagrees with any of the provisions of the Agreement, the User has no right to use the Site and the Service.
1.6. If the AI Beauty Bot has made any changes to the Agreement in the manner prescribed by paragraph 10.5. of the Agreement with which the User does not agree, he/she is obliged to stop using the Site and the Service.

2.Terms
2.1. Account – a User account, which is a set of data about the User and is necessary for identifying the User and providing access to the functionality of the Site and/or Service.
2.2. Login and Password – a system of personal identification of the User used to access the Account.
2.3. User – any person who in one way or another uses the functionality of the Site and/or Service.
2.4. Site – a website located at ai-beauty.bot
2.5. Service – AI Beauty Bot software.

3.Subject
3.1. In accordance with this Agreement, the AI Beauty Bot grants Users the right to use the Service under the terms and conditions stipulated by the Agreement.
3.2. The AI Beauty Bot ensures the operability of the Service and also assists Users in their use of the Service’s functionality.
3.3. In the part addressed to all Users, regardless of the fact of using the functionality of the Service, this Agreement is a license agreement. The AI Beauty Bot is entitled, at its own discretion, to refuse the User access to the functionality of the Service, as well as to terminate access.
3.4.The functionality and purpose of the Service do not provide for use for household, family or other personal needs. The Service is subject to use in the implementation of entrepreneurial activities. The User is not a consumer.

4.Use of the Service
4.1. The main functional purpose of the Site is to provide information about the Service, demonstrate its capabilities, the cost of using the Service, the payment procedure, other information about the Service and the AI Beauty Bot, as well as provide access to the functionality of the Service.
4.2. The AI Beauty Bot service is software, the main functional purpose of which is to provide the User with the ability to automate communication processes with clients - end consumers.
4.3.The service provides the following features:
4.3.1.automation of communication processes with the User's clients, including through third-party services (Telegram, Instagram, WhatsApp, Viber);
4.3.2.analysis of customer preferences, formation of personal recommendations based on the analysis;
4.3.3.creating and sending advertising messages to clients;
4.3.4.integration with third-party record-keeping and scheduling tools, as well as CRM systems (Google Calendar, Altgio, Yclients, Dikidi, 1C, AmoCRM, Salonized, Fresha, Booksy, Boulevard, GlossGenius).
4.4. The description, conditions, connection regulations and other information about the Service are indicated in the relevant sections of the Site, which the User must read before connecting to the Service.
4.5. The User must complete the registration procedure and create an Account to gain access to the functionality of the Service. Registration is performed by filling out forms in the relevant section of the Site.
4.6. When registering, the User undertakes to provide accurate and complete information and to keep this information up to date. If the User provides incorrect information or the AI Beauty Bot has reason to believe that the information provided by the User is incomplete or inaccurate, the AI Beauty Bot is entitled, at its sole discretion, to refuse registration, block or delete the User's Account and refuse the User use of the Service.
4.7. When using the Site and the Service, the User is obliged to act in good faith and not to allow the exercise of rights granted by the Agreement or the law for the purpose of obtaining unjustified benefits or causing harm to the AI Beauty Bot.
4.8. The AI Beauty Bot is entitled, at its own discretion, at any time, without prior notice to the User, to check the good faith of his actions. The AI Beauty Bot is entitled to take any measures available to it to prevent unfair use of the Site and/or Service, including terminating access to both the Site and/or Service without prior notice and explanation of the reasons.
4.9. The AI Beauty Bot is entitled, without explanation, at its own discretion, to refuse the User registration and access to the Service
4.10. The User is solely responsible for the security (including resistance to guessing) of the Login and Password chosen by him/her, and independently ensures their confidentiality. All actions within the framework of using the Service under the User account are considered to be performed by the User himself/herself.

5.Special Rights
5.1. The AI Beauty Bot controls the User's compliance with the rules for using the Site and the Service, and ensures their functioning. The AI Beauty Bot is entitled, at its own discretion, to request information from the User related to the use of the Service. The AI Beauty Bot is entitled to restrict the User's access to the Site and the Service, and to establish any restrictions on their use.
5.2. The AI Beauty Bot is entitled, at its own discretion, to qualify the User's actions as unfair and/or violating the rules of use and apply appropriate sanctions. When blocking the Account, the User undertakes to contact the AI Beauty Bot and independently take all actions to stop the violation.
5.3. The AI Beauty Bot is entitled to change, modify and update the Site and Service without the consent and notification of the User, collect any information for the purpose of generating statistics on their use, carry out preventive work that entails the suspension of the Site and/or Service. The inability to use the Site and/or Service for the reasons specified in this paragraph is not a violation on the part of the AI Beauty Bot.
5.4. The AI Beauty Bot is entitled to provide the User with technical and information support.

6.Restrictions on Use
6.1. IT IS PROHIBITED TO USE THE SITE AND THE SERVICE FOR THE PURPOSE OF CAUSING HARM TO OTHER USERS, THE AI BEAUTY BOT OR THIRD PARTIES, AS WELL AS FOR THE PURPOSE OF OBTAINING UNJUSTIFIED BENEFITS AT THEIR EXPENSE. IT IS PROHIBITED TO BEHAVE IN BAD FAITH WHEN USING THE SITE AND THE SERVICE, INCLUDING PROVIDING FALSE INFORMATION TO THE AI BEAUTY BOT, DECEPTION AND/OR MISLEADING.
6.2. IT IS PROHIBITED TO CHANGE, DECOMPILE, DISASSEMBLE, DECRYPT OR PERFORM OTHER ACTIONS WITH THE SOURCE CODE OF THE SITE AND/OR SERVICE, AIMED AT OBTAINING INFORMATION ABOUT THE IMPLEMENTATION OF THE ALGORITHMS USED, OR TO CREATE DERIVATIVE WORKS USING THE SITE AND/OR SERVICE.
6.3. IT IS PROHIBITED TO TAKE ACTIONS AIMED AT DISRUPTING THE NORMAL FUNCTIONING OF THE SITE AND SERVICE, AS WELL AS HACKING THEM.
6.4. IT IS PROHIBITED TO USE THE SITE AND THE SERVICE TO SEND SPAM, I.E. MESSAGES OF A COMMERCIAL OR NON-COMMERCIAL NATURE IN THE FORM OF (INCLUDING, BUT NOT LIMITED TO): ADVERTISING OF GOODS WHOSE CIRCULATION IS PROHIBITED OR RESTRICTED; LISTS OF EMAIL ADDRESSES; FINANCIAL PYRAMID SCHEMES, NETWORK MARKETING, REFERRAL LINKS, ETC.
6.5. USE THE SITE AND SERVICE TO DISTRIBUTE, STORE, TRANSMIT IN ANY FORM INFORMATION THAT CONTAINS MALICIOUS SOFTWARE (VIRUSES, TROJANS OR OTHER COMPUTER CODES, FILES OR PROGRAMS) DESIGNED TO DISRUPT, DESTROY OR LIMIT THE FUNCTIONALITY OF ANY EQUIPMENT (THEIR PARTS), TO IMPLEMENT UNAUTHORIZED ACCESS, TO GAIN ACCESS TO COMMERCIAL SOFTWARE PRODUCTS BY PROVIDING SERIAL NUMBERS OF LOGINS, PASSWORDS, PROGRAMS FOR THEIR GENERATION AND OTHER MEANS TO GAIN UNAUTHORIZED ACCESS TO PAID RESOURCES, AS WELL AS POSTING LINKS TO THE ABOVE INFORMATION.
6.6. IT IS PROHIBITED TO TRANSFER THE LOGIN AND PASSWORD, OR OTHERWISE PROVIDE ACCESS TO THE ACCOUNT TO THIRD PARTIES.

7.Payment
7.1. Current prices, as well as categories by which the User can purchase access to the Service's capabilities, are posted on the Site. The AI Beauty Bot is entitled to unilaterally, without prior notice to Users, change the cost of using the Service.
7.2. The User pays for the cost of the Service personally, via the use of the functionality of the Site.
7.3. Payment is made by wire transfer to a bank account. The User's payment obligations are considered fulfilled from the moment the funds are credited to the AI Beauty Bot's bank account.
7.4. The site is connected to Internet acquiring, the User can pay the fee with a bank card. After confirming the selected service, a secure window will open with the payment page of the processing center, where the User must enter the bank card details. If the User's bank supports this technology, the User will be redirected to the bank's server for additional identification. The User can clarify information about the rules and methods of additional identification with the User's bank.

8.Limitation of liability. Force Majeure
8.1. The User shall be liable for full compensation for damages caused to the AI Beauty Bot by his actions.
8.2. THE AI BEAUTY BOT SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT CONSEQUENCES OF ANY USE OR INABILITY TO USE THE SITE AND THE SERVICE AND/OR DAMAGES (BOTH ACTUAL DAMAGE AND LOST PROFITS) CAUSED TO THE USER AND/OR THIRD PARTIES, INCLUDING THE USER'S EMPLOYEES, AS A RESULT OF ANY USE OR NON-USE OF THE SERVICE AND/OR THE SITE OR ITS INDIVIDUAL COMPONENTS, INCLUDING DUE TO POSSIBLE ERRORS OR FAILURES IN THEIR OPERATION, FOR THE INABILITY TO USE THE SITE AND/OR THE SERVICE FOR REASONS BEYOND THE CONTROL OF THE AI BEAUTY BOT, ANY ACTIONS AND/OR INACTIONS OF SERVICE PROVIDERS, SERVICES, NETWORKS, SOFTWARE OR EQUIPMENT, THE SUITABILITY OF ADDITIONAL OPTIONS FOR ANY PURPOSES OF THE USER, INCLUDING COMMERCIAL ONES, THE SAFETY OF FINANCIAL DATA TRANSMITTED TO THE SITE, THE SECURITY OF THE USER'S LOGIN AND/OR PASSWORD, UNAUTHORIZED AND/OR ILLEGAL USE OF THE USER'S LOGIN AND/OR PASSWORD BY THIRD PARTIES, DAMAGE THAT MAY BE CAUSED TO ANY DEVICES AND STORAGE MEDIA AND/OR THE USER'S SOFTWARE AS A RESULT OF USING THE SITE AND/OR THE SERVICE.
8.3. The AI Beauty Bot's liability, including compensation for damages, is limited to the amount of the Service cost paid by the User in the reporting period in which the Parties recorded the fact of damage to the User. The AI Beauty Bot compensates only direct documented actual damage. Lost profits, expenses for representatives, related costs, other compensations and financial guarantees are not subject to payment. The Parties understand the reporting period to be one calendar month, regardless of the term of acquisition of the license.
8.4. The AI Beauty Bot is not a party to any transactions between the User and its clients and neither directly nor indirectly determines their basic and additional conditions, does not make settlements between the User and its clients. All obligations under transactions arise directly between the User and its clients.
8.5. The AI Beauty Bot shall not be held liable if the actual functionality of the Site and/or Service for one reason or another does not meet the User's expectations. The Service is provided on an "as is" basis. The AI Beauty Bot does not guarantee, including but not limited to, security and safety, accuracy, completeness, performance, system integration, uninterrupted operation, absence of errors, correction of malfunctions, absence of viruses, legality of use in any territories, and does not provide any other guarantees not expressly stated in this Agreement.
8.6. Force majeure (force majeure) — any action, event or circumstance that is not the result of the activities of the Parties or is beyond the control of the Parties, including technical problems with the Site and/or Service, natural disasters, fire, flood, earthquake, extreme weather conditions, military actions, actions of government agencies and other events, if as a result of such actions/events the fulfillment of contractual obligations is complicated (becomes impossible). Software and hardware errors that lead to the User being unable to access the Site and/or Service are force majeure circumstances and grounds for exemption from liability.
8.7. In the event of force majeure, each Party shall undertake all actions within its control to reduce the losses that may be caused by such circumstances for both Parties. If force majeure and its consequences continue to operate for more than two months, the Parties shall conduct additional negotiations to identify acceptable alternative methods of fulfilling this Agreement.

9.Intellectual property
9.1. The Site, the Service and all their components (program code, design, layout, database) are the results of intellectual activity, the exclusive rights to which belong to the AI Beauty Bot.
9.2. Access to the Site is provided free of charge under the terms of a simple (non-exclusive) license for the term of the Agreement throughout the world, use of the Service is carried out on a paid basis in accordance with Section 7 of the Agreement. None of the provisions of the Agreement shall mean the transfer to the User of exclusive rights to both the Service and the Site and their components.
9.3. The Service and the Site may be used by the User solely for the purposes specified in the Agreement.
9.4. In case of violation of the terms of this section, the User shall be liable in accordance with the current legislation and shall compensate the AI Beauty Bot for losses in full, including lost profits.

10.Modification and termination of the Agreement
10.1. In the part addressed to all Users, regardless of the use of the Service, the Agreement shall enter into force from the moment of the beginning of the use of the Site. In the part regulating the use of the Service, the Agreement shall enter into force from the moment of completion of the registration procedure. The Agreement is of unlimited duration.
10.2. This Agreement applies to all Users, regardless of whether they have completed the registration procedure, except in cases where the meaning of a particular provision directly and clearly indicates that it is addressed to a registered User.
10.3. The Agreement may be terminated at the User's initiative, for which purpose an application to terminate the use of the Service must be sent to the AI Beauty Bot's e-mail address or via the feedback form. The application is reviewed by the AI Beauty Bot within 20 business days, after which the User is notified of the termination of the Agreement, termination of access to the Service, after which the Account is subject to deletion. A proportional refund of the funds paid for the use of the Service is not made.
10.4. The Agreement may be terminated at the initiative of the AI Beauty Bot either due to the User's violation of the rules of use or without justification. The AI Beauty Bot is entitled to completely stop the functioning of the Site and Service.
10.5. The AI Beauty Bot is entitled to unilaterally amend the Agreement. The new version of the Agreement is published in accordance with paragraph 1.2. of the Agreement and is subject to application to the relationship between the Parties from the moment of publication. The User is obliged to independently monitor changes in the version of the Agreement.
10.6. The User does not have the right to unilaterally change the terms of the Agreement.

11.Final Provisions
11.1. In relations with the AI Beauty Bot, the User acts on his own behalf and at his own expense.
11.2. The User shall independently bear all costs associated with the use of the Site and/or Service, including payment for Internet communication.
11.3. All other conditions not specified in this Agreement shall be governed by the current legislation of the place of incorporation of the AI Beauty Bot.
11.4. The claim procedure is mandatory for the Parties. The Parties resolve any disputes that arise through negotiations. The response period for a claim is 15 (fifteen) calendar days after receipt by the addressee. After the Parties have taken steps to resolve the dispute out of court, if it is impossible to resolve the dispute through negotiations, the dispute is referred to the court at the location of the AI Beauty Bot.
11.5. Personal data received by the AI Beauty Bot from the User is processed in accordance with applicable legal requirements and the Policy adopted by the AI Beauty Bot in the field of processing and protection of personal data.
11.6. IN THE CASE OF TRANSFER OF PERSONAL DATA OF THIRD PARTIES BY THE USER TO THE AI BEAUTY BOT, THE USER IS RESPONSIBLE TO ENSURE THAT THEY OBTAIN CONSENT TO SUCH TRANSFER. OBTAINING SUCH CONSENT IS IMPLIED IN ALL CASES OF TRANSFER OF PERSONAL DATA THROUGH THE SERVICE. IN THE EVENT OF RECEIVING ANY CLAIMS AGAINST THE AI BEAUTY BOT REGARDING THE PROCESSING OF SUCH PERSONAL DATA, INCLUDING FROM PERSONAL DATA SUBJECTS OR AUTHORITIES, THE USER IS OBLIGED TO ASSIST THE AI BEAUTY BOT IN SETTLING SUCH CLAIMS AND PROVIDE THE AI BEAUTY BOT WITH ALL THE INFORMATION REQUESTED BY HIM. IN THE EVENT OF LOSSES BY THE AI BEAUTY BOT, INCLUDING THOSE EXPRESSED IN PUBLIC PENALTIES, THE USER IS OBLIGATED TO REIMBURSEMENT THEM IN FULL WITHIN 2 WORKING DAYS FROM THE MOMENT THE AI BEAUTY BOT SUBMITS A CLAIM FOR REIMBURSEMENT, INCLUDING IN THE CASE OF VOLUNTARY SATISFACTION OF THE CLAIMS BY THE AI BEAUTY BOT.
11.7.The Parties have agreed that the priority method of exchanging legally important messages is communication via the functionality of the Site or sending emails with the relevant attachments to the following addresses:
11.7.1. AI Beauty Bot's email: hello@ai-beauty.bot

11.7.2. User's email: the email address specified by the User upon registration on the Site.
